TERMS OF SERVICE (COMMISSIONS)

For TRAUMA commissions – 3D modeling work, adapted for XIV & Second Life

1. GENERAL

  • All commissions are treated as original 3D artwork created and designed from scratch.

  • Adaptation into XIV or Second Life formats is considered an additional service provided for private, personal use only.

  • I reserve the right to decline any project for any reason.

  • Commission work is for personal use only unless a separate commercial agreement is made.

  • Clients must specify the target platform (XIV or Second Life) at the start. Additional fees apply if you request refits to multiple platforms.


2. Payment & Refunds

  • 50% upfront deposit is required before work begins.

  • The remaining 50% balance is due once the final files are ready for delivery.

  • Payments are non-refundable once the initial model draft / blockout stage has been completed, since significant work will already have been done.

  • If I determine that a project cannot be completed or must be cancelled for any reason, the deposit will be refunded in full.

  • In case of cancellation, no unfinished or partial files will be delivered.


3. Revisions

  • Minor adjustments (small fixes, proportion tweaks, simple edits) are included.

  • Major changes (large redesigns, style changes, new requests outside the agreed scope) may require additional fees.

  • Revisions will only be made during the WIP (work-in-progress) stage. Once final files are delivered, no further edits are included.


4. Usage Rights

  • The commissioned work is for private, personal use only.

  • Redistribution, resale, re-uploading, or claiming the work as your own is strictly forbidden.

  • Work cannot be used for NFTs, blockchain projects, or similar purposes.

  • Commercial usage (e.g., brand, marketplace products, advertising) requires a separate written agreement.


5. Artist Rights

  • I retain full copyright and authorship of all created 3D work, including models, textures, and designs.

  • By commissioning me, you are purchasing a license to use the finished work privately, not ownership of the original files or design.

  • You are allowed to make personal edits (such as private texture adjustments, refits, or recolors) as long as these edits remain for your own private use.

  • You are not allowed to extract, modify, or reuse the assets for commercial, shared, or redistributed purposes in any form.

  • I may showcase completed commissions in my portfolio, store, or social media unless you specifically request privacy in advance.


6. Prohibited Content

  • I will not create work that includes:

  • Minors, child-like characters, or Lalafell content.

  • Real people likenesses without consent.

  • Extreme NSFW, fetish, or explicit sexual acts.

  • Hard gore (graphic organs, mutilation).

  • Hate-related, extremist, or political symbols (e.g., Nazi, fascist, communist propaganda).

  • Sacred or sensitive religious content (e.g., Islamic, Buddhist, Hindu).

  • Allowed in style context: aesthetic crosses, pentagrams, gothic/occult-inspired symbols (for fashion themes).


7. Delivery

  • Final work is delivered digitally in the agreed packaged format for XIV or Second Life.

  • Raw files (FBX, OBJ, Blender, Marvelous Designer, Substance Painter, etc.) will not be provided unless explicitly agreed under a separate contract.

  • The time needed to complete a project is different for every commission.

  • I will give you an estimated completion time after reviewing your request.

  • If you need the work faster, I may offer this for an extra rush fee.


8. Platform Terms & Respect

  • All commissioned work is primarily original 3D artwork created by me.

  • For compatibility and workflow reasons, certain technical game data (skeletons, bones, weighting) and minor mesh elements may be used when necessary.

  • No full official outfits, logos, or large copyrighted assets from Square Enix or Linden Lab are redistributed.

  • I am not affiliated with Square Enix, Linden Lab, or their partners.

  • Clients are responsible for respecting the Terms of Service of XIV and Second Life when using the commissioned work.

  • As per Square Enix’s guidelines, commissions must remain private, aesthetic-focused, and not discussed or advertised inside the game itself.


9. Communication

  • All communication will be handled in English by default.

  • Thai communication is acceptable if the client can express ideas clearly.

  • Clients are responsible for ensuring their messages and references are understandable.

  • Misunderstandings caused by unclear communication will not be my responsibility.


10. Agreement

  • By commissioning me, you confirm that you have read, understood, and agreed to all the terms listed above.

  • Failure to follow these terms may result in project cancellation, loss of commission rights, and refusal of future work.

  • These terms exist to protect both the artist’s rights and to ensure a fair, respectful, and transparent process for every client.

TRAUMA is an independent digital art brand creating original 3D designs and assets.Each release represents countless hours of creative and technical work.
These terms exist to protect my rights and boundaries — not to threaten or restrict genuine supporters.
If you obtained my work through official sources (Ko-Fi or Patreon), you are welcome to enjoy it for personal use under the guidelines below.If you downloaded from unauthorized mirrors, leaks, or reposts, you are using stolen content and may be subject to copyright enforcement under international law.Respect independent artists.

Public Release Terms of Service

By downloading, installing, or using any TRAUMA digital product (“the Work”),
you agree to the following legally binding terms.

1. Ownership & Copyright

  • All 3D models, textures, meshes, packaging, and related materials are the exclusive intellectual property of TRAUMA.

  • Protected by international copyright law, including the Berne Convention and WIPO treaties.

  • Copyright arises automatically upon creation; all rights not expressly granted are reserved.


2. License for Personal Use

  • You are granted a limited, non-transferable, non-exclusive, revocable license to use the Work for private, non-commercial purposes only.

  • This license does not grant ownership or redistribution rights.


3. Prohibited Activities

You may not:

  • Upload, mirror, or rehost TRAUMA assets on any third-party platform, Discord, or Telegram.

  • Sell, trade, or include the Work in paid or donation-based content.

  • Modify, port, or release derivative versions publicly without written consent.

  • Remove or alter TRAUMA branding, metadata, or credits.

  • Use the Work in NFTs, AI datasets, or blockchain projects.

Violation constitutes intentional copyright infringement and may result in DMCA takedown and civil liability.


4. Enforcement

TRAUMA reserves the right to:

  • Issue DMCA takedowns and cease-and-desist orders.

  • Preserve and submit evidence of infringement.

  • Seek civil damages, injunctive relief, and attorney’s fees where applicable.

  • Blacklist repeat offenders across all TRAUMA platforms.


5. Edits & Permission

I always appreciate proper credit when my work is featured or used as part of another project.Credit isn’t mandatory for private use — but it helps support my work and lets others find the original creator.


7. Liability Disclaimer

TRAUMA’s works are independent artistic creations, not affiliated with Square Enix Co., Ltd., Linden Lab, or any other company.They do not modify, replace, or interfere with any official game systems, assets, or online functionality.
All 3D models and textures are original creations produced solely by TRAUMA.
Any technical compatibility with existing game frameworks is incidental and intended only for private, aesthetic use by the end user.No official game assets, data, or code are included, reused, or distributed in any form.Use at your own risk; TRAUMA assumes no responsibility for client-side conflicts, crashes, or data corruption arising from installation or personal modification.


8. Governing Law

Governed by the laws of Thailand.
TRAUMA may enforce rights in any jurisdiction where infringement occurs.
Prevailing party is entitled to recover legal fees and costs.


9. Evidence Preservation

TRAUMA may retain evidence (screenshots, logs, URLs) of unauthorized use for potential legal enforcement.


10. Final Notice

Unauthorized redistribution or commercial use of TRAUMA works will trigger platform enforcement and possible legal action.
Even if no action is taken immediately, all rights are reserved to pursue infringement at any time.
